Rosmah Ordered To Pay RM67.5 Million Over Unreturned Luxury Jewellery

High Court Rules In Favour Of Lebanese Jeweller

Datin Seri Rosmah Mansor has been ordered by the Kuala Lumpur High Court to pay RM67,461,027.37 to Lebanese luxury jeweller Global Royalty Trading SAL Ltd after failing to return 43 pieces of jewellery entrusted to her on a consignment basis. In a judgment delivered on 10 June, High Court Judge Datuk Quay Chew Soon ruled in favour of the company, finding that Rosmah had failed to account for the whereabouts of the jewellery, which remained the jeweller’s property throughout. The court ordered her to settle the RM67.5 million payment within one month together with 5% annual interest from the date of judgment until full payment. She was also ordered to pay RM75,000 in legal costs to the jeweller, while another RM75,000 was awarded to the government and the Inspector-General of Police.

Court Finds 43 Jewellery Pieces Were Never Returned

The case involved 44 pieces of jewellery valued at USD14.57 million, or approximately RM68.3 million, which Global Royalty Trading claimed had been delivered to Rosmah in 2018 for viewing on a consignment basis. According to court findings, only one item, a diamond emerald bracelet, was eventually recovered and returned, leaving 43 pieces unaccounted for. Judge Quay noted that it was undisputed that the jewellery had been delivered to Rosmah, received for viewing purposes, never purchased or paid for, and largely never returned. He ruled that once delivery, possession, and non-return had been established, it became Rosmah’s responsibility to explain what happened to the items while they were under her custody. The judge also referred to Rosmah’s earlier court admissions acknowledging that the jewellery belonged to the company and had been supplied on consignment.

Claim Against Authorities Dismissed

Rosmah argued that the missing jewellery had been seized during police raids connected to investigations into the 1MDB scandal in 2018 and sought indemnity from the Inspector-General of Police and the government. However, the court rejected that argument after finding no evidence that the 43 missing pieces had ever been confiscated by authorities. Judge Quay noted that only one jewellery item had been identified in forfeiture proceedings and subsequently returned to the plaintiff. He further ruled that Rosmah failed to prove the missing items had been packed, stored, and later seized during the police operation, leading to the dismissal of her third-party claim against the IGP and the government. The court ultimately concluded that Rosmah had failed in her legal duty to safeguard and return the entrusted jewellery, with the non-return amounting to prima facie negligence under the law.
