Vivy Yusof and Fadza Anuar Plead Not Guilty to Misusing PNB & Khazanah Funds

The founders of the popular e-commerce platform, FashionValet (FV), Datin Vivy Yusof and her husband, Datuk Fadzarudin Shah Anuar, are once again in the spotlight after being charged in the Kuala Lumpur Sessions Court for alleged misuse of public funds belonging to Khazanah Nasional Berhad (Khazanah) and Permodalan Nasional Bhd (PNB).

Both pleaded not guilty to the criminal breach of trust charges involving a payment of RM8 million from FV’s bank account to another company, 30 Maple Sdn Bhd. The charges concern investments made by PNB and Khazanah, with the alleged incident occurring on August 21, 2018, at a bank in Bukit Damansara.

Charges and Penalties

According to the alternative charge, Vivy, 38, and Fadza, 37, were charged under Section 403 of the Penal Code, read together with Section 34 of the same code. If convicted, they face imprisonment of not less than six months and not more than five years, along with a fine or whipping.

RM100,000 Bail Each

Deputy Public Prosecutor Haresh Prakash Somiah proposed a bail amount of RM100,000 per accused, with one surety, as determined previously. Sessions Court Judge Rosli Ahmad granted the request, and defense lawyer Ashok Athimulan raised no objections to the decision.

Case Mention Date

The prosecution requested a mention date to submit relevant documents to the defense. The court has set March 10 as the next mention date for the case.

Case Background

The controversy began with reports that public funds worth RM43.9 million from Khazanah and PNB invested in FashionValet had been lost. These allegations led to an investigation into an RM8 million payment to another company, now forming the basis of this court case.

Despite the accusations sparking heated debates among the public, Vivy and Fadza have maintained their innocence. With the trial ongoing, Malaysians are closely monitoring developments in the case.
