Retired Teacher Ordered To Pay RM88,000 After Slapping 14-Year-Old Student Four Times
Four Slaps In Class Ended Up Becoming An RM88,000 Court Case
Something that happened inside a classroom seven years ago has now ended with a pretty hefty price tag. The Kota Bharu High Court has ordered retired teacher Isamuddin Ismail, 63, to pay RM88,069 to his former student, Mohamad Adam Maidin, after ruling that he had committed battery against him.
The incident happened on 28 January 2019, when Adam was just 14 years old and studying in Form Two. According to the case, Adam was sitting at his desk with his classmates when Isamuddin approached him from behind and slapped him four times. Adam later experienced pain around his face and ears, dizziness, ringing in his ears and reduced hearing. A medical report from June 2019 found that he had suffered traumatic injuries, including mild to moderate mixed hearing loss and problems with his right ear.
He Eventually Moved To Another School
The incident didn’t just leave Adam dealing with physical symptoms. About a month later, he transferred to another school because he was afraid to return and face the teacher.
Seven years later, High Court judge Datuk Mohd Rosli Yusoff ruled in Adam’s favour. His lawyer said the RM88,069 awarded included RM45,000 in general damages, RM569 in special damages, RM11,250 in exemplary damages, another RM11,250 in aggravated damages, and RM20,000 for interest and costs.
The lawsuit named Isamuddin, the school’s principal, the education director-general and the Malaysian government as defendants. Adam and his mother, Noor Azleen Mohamad, brought the lawsuit and were represented by lawyer Mohd Syukran Mohd Noordin, while the defendants were represented by senior federal counsel Siti Syakimah Ibrahim.
