Faulty Badminton Racket Caused Life-Changing Injury
A former secondary school student has been awarded more than RM452,000 after winning a negligence lawsuit over a school sports accident that left him with permanent injuries. The incident took place on 17 September 2019 at SMK Chaah in Segamat, Johor. Muhammad Syakir Irfan Syed Ali, who was then a Form Two student, had just completed a Physical and Health Education (PE) class before using a school badminton racket to play casually with his classmates. During the game, the metal shaft of the racket suddenly detached from its handle and flew into his left eye.
High Court Found School Authorities Negligent
The accident left Syakir with a penetrating eye injury, a fractured skull and acute brain haemorrhage, resulting in permanent damage to his vision and nervous system. Acting through his father while he was still a minor, Syakir filed a negligence suit against the PE teacher, the school principal, the Director-General of Education and the Malaysian government. According to The Star, High Court Judge Kalyana Kumar ruled entirely in Syakir’s favour, finding that the defendants had failed to provide adequate supervision and effective monitoring while the students remained under the school’s care.
Court Awards More Than RM452,000 In Compensation
Following the judgment, the court ordered the defendants to pay Syakir more than RM452,000 in total compensation. The award included RM400,000 in general damages, RM12,809 in special damages and RM40,000 in legal costs. While the compensation cannot reverse the permanent injuries he sustained, the case has highlighted the importance of proper supervision during school activities and regular safety checks on sports equipment used by students.
